4. Limited Performance Guarantee

LeadtoListingAi may offer a conditional performance guarantee related to a specific number of listing appointment opportunities within a defined period of time (e.g., “10 listing appointments in 90 days or you don’t pay”), as described in a separate written agreement or offer.

This guarantee applies strictly to the number of qualified appointment opportunities generated and does not guarantee:

- Signed listing agreements

- Closed transactions

- Revenue

- Profit

- Business growth

Eligibility for any refund or performance-based adjustment is subject to compliance with agreed-upon conditions, including but not limited to:

- Timely cooperation

- Implementation of required systems

- Adherence to campaign requirements

- Attendance at scheduled calls

- Proper follow-up procedures

Refund terms, including partial refund tiers based on appointment volume, are defined separately and communicated during the sales process.

Except for the limited performance guarantee explicitly stated in writing, all services are provided without warranty of results.

5. Payments & Fees

Payments may be made via:

- Stripe

- Bank transfer

- Wise

All payments are final unless otherwise stated in a separate written agreement.

You are responsible for any applicable taxes or transaction fees.

Failure to complete payment may result in suspension or termination of services.

6. Intellectual Property

All content, materials, systems, frameworks, documents, AI infrastructure, and strategies provided by LeadtoListingAi remain the intellectual property of HM Growth Consulting LLC unless otherwise agreed in writing.

You may not:

- Copy

- Resell

- Distribute

- Reproduce

- Reverse engineer

Without written consent.

7. User Responsibilities

You agree not to:

- Use our services for illegal activities

- Provide false information

- Attempt to disrupt or hack our systems

- Misrepresent our services

You are solely responsible for how you implement any strategies or systems provided.

8. Limitation of Liability

To the fullest extent permitted by law:

HM Growth Consulting LLC shall not be liable for:

- Indirect damages

- Lost profits

- Business interruption

- Data loss

- Consequential damages

Our total liability shall not exceed the amount paid by you for the services.

9. Indemnification

We are not responsible for the performance, policies, or availability of these platforms.

We reserve the right to terminate access to our services at our discretion if you violate these Terms.

12. SMS Communications & Mobile Terms

By providing your mobile phone number through our website, booking forms, or other opt-in mechanisms, you consent to receive SMS messages from LeadtoListingAi for business-related purposes.

Types of messages may include:

- Appointment confirmations

- Appointment reminders

- Service-related notifications

- Follow-up regarding inquiries

- Account-related communications

Message frequency may vary.

Message and data rates may apply depending on your mobile carrier plan.

You may opt out of SMS communications at any time by replying “STOP” to any message received. For assistance, reply “HELP” or contact us at [email protected].

Opting out will prevent you from receiving further SMS messages unless you re-subscribe.

Carriers are not liable for delayed or undelivered messages.

We do not sell, rent, or share mobile phone numbers with third parties for marketing purposes.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, United States.

Any disputes shall be resolved in the courts located in New Mexico.
